Abstract
1. Introduction and Objective
The expansion of the tourism industry as a multidimensional phenomenon with economic, cultural, social, and technological implications has underscored the need to develop a jurisprudential framework for analyzing and regulating its associated relationships. Nevertheless, the absence of a coherent theoretical framework and the inadequacy of systematic subject identification remain among the principal gaps in this field. This study aims to explicate the relevant jurisprudential approaches and propose an operational model for identifying issues in tourism jurisprudence.
2. Methods and Materials
This applied study adopts an analytical–deductive method. Data were collected and analyzed through a systematic review of domestic and international literature and a qualitative content analysis of jurisprudential sources, hadith literature, and contemporary studies.
3. Research Findings
The findings indicate that the three approaches of traditional jurisprudence, governmental jurisprudence, and civilizational jurisprudence each address certain dimensions of tourism; however, their integration provides a more comprehensive framework for engaging with the complexities of this industry. Moreover, the subject matter of tourism jurisprudence can be organized around four axes: theoretical foundations, general jurisprudence, jurisprudence of tourists, and jurisprudence of the tourism industry. At the methodological level, the interactive approach was identified as the most effective approach to subject identification, and a five-stage operational model was developed accordingly.
4. Discussion and Conclusion
The findings indicate that the effectiveness of jurisprudence in addressing emerging issues in tourism depends on systematically integrating jurisprudential reasoning with interdisciplinary data and prioritizing subject identification over the determination of legal rulings. By enhancing the analysis of issues at the individual, social, and governance levels, the proposed model strengthens the capacity of jurisprudence to provide practical solutions for Islamic policy-making and facilitates the development of a coherent framework for tourism jurisprudence.
