Jurisprudential Approaches and Models of Issue-Identification in the Analysis of Tourism Industry

Abstract
1- Introduction and Objective

The expansion of the tourism industry as a multidimensional phenomenon has highlighted the necessity of developing a jurisprudential framework for its analysis and regulation. The objective of the present research is to explain jurisprudential approaches and present an operational model for issue identification in tourism jurisprudence.

2- Materials and Methods

This research is applied in terms of objective and analytical-inferential in terms of method. Data were collected and analyzed through a systematic review of domestic and international literature and qualitative content analysis of jurisprudential sources, narrations, and contemporary studies.

3- Research Findings

The results showed that the three approaches of traditional jurisprudence, governmental jurisprudence, and civilizational jurisprudence each cover part of the dimensions of tourism, but their integration provides a more comprehensive framework for dealing with the complexities of this industry. Also, the structure of tourism jurisprudence topics can be organized into four axes: "Theoretical Foundations", "General Jurisprudence", "Tourist Jurisprudence", and "Tourism Industry Jurisprudence". At the methodological level, the interactive approach was identified as the superior approach in subject identification, and based on it, a five-stage operational model was presented.

4- Discussion and Conclusion

The findings indicate that the efficiency of jurisprudence in dealing with emerging tourism issues depends on the systematic linkage of jurisprudential ijtihad with interdisciplinary data and the precedence of subject identification over ruling identification. By elevating the analysis of issues at individual, social, and governance levels, the model also increases the capacity of jurisprudence to provide operational solutions in Sharia policy-making.
